Regularisation Procedure 2020: Check Out Our Frequently Asked Questions
After weeks of discussions and uncertainty, the so-called Relaunch Decree (Decree Law no. 34 of 19 May 2020, Article 103) finally laid out the procedure for the regularisation of Italian or foreign citizens involved in one of the following work sectors: agriculture, farming and husbandry, fisheries and aquaculture and related activities; caretaker work, including care workers for the elderly or people with disabilities; domestic housework in support of family needs. This regulatory action came at a historic moment. Several different fronts and actors were stressing the need for such a measure, to ensure, first of all, that hundreds of thousands of invisible people could take the first step to regularise their status in Italy and see their rights finally recognised.
Article 103 of the Relaunch Decree provides for two regularisation options. On the one hand, it allows for an employer (an Italian or EU citizen or a third-country national holding a EU long-term residence permit, a residence card for a family member of an EU citizen, or a permanent residence card for a family member of an EU citizen) to offer third-country nationals an employment contract or to bring to light undeclared work in which both Italian and foreign citizens may be involved. On the other hand, it gives the opportunity to third-country nationals, whose residence permit expired on or after 31 October 2019, to apply for a 6-months “job-search permit”.
In either case, to access the regularisation procedure, interested parties must meet a series of requirements that have been set out in the Relaunch Decree, the following interministerial decree, the circulars of the Department for Civil Liberties and Immigration and the Department of Public Security, and subsequent clarifications delivered by competent departments.
