CILD and Progetto Diritti contribution to UN, in collaboration with IDC
Alongside the International Detention Coalition (IDC), we submitted a contribution to the United Nations Special Rapporteur on the human rights of migrants. In particular, the document addressed the impact of the externalization of migration management on the rights of migrants.
CILD and Progetto Diritti submitted observations concerning the evolution of the Italy-Albania Protocol signed by the Meloni government in November 2023, which effectively became operational as of October 2024.
We highlighted how the system established in implementation of the Protocol has faced opposition from national courts in charge of validating the detention of migrants in the Pre-removal Detention Centre (Centro di Permanenza per il Rimpatrio, CPR) built on Albanian territory, and how the government bypassed this judicial obstruction through ad hoc legislative measures. Moreover, we firmly denounced that the externalization of procedures weakens the monitoring of conditions and increases the vulnerability to violations of fundamental rights of the individuals who are deported and detained in Albanian facilities. In particular, the right to legal defence is severely compromised, and the assessments regarding the suitability for detention are inadequate and superficial, as evidenced by the emergence of cases involving serious vulnerability conditions and the presence of minors.
Finally, we reiterated that the administrative nature of migrant detention creates inhumane conditions that amount to serious violations of fundamental rights, and for this reason, we strongly support the abolition of the CPR system both in Italy and in Albania.
